1. Introduction
Black Dog Limo is a private car and limousine service company located in West Palm Beach, Florida. This agreement lists the terms between you and Black Dog Limo for the purchase of airport and point to point private car and SUV transportation, and all other services we provide.
2. Changes to this agreement
If we change this agreement we will post the revised version on this website and include it with every future reservation confirmation, and that version replaces the terms of this one. Continuing to use the services after we post a revised agreement means you accept it. If you do not agree with these terms, or with any revised version, please do not continue to use the services.
Signed contracts are grandfathered and are not subject to later revisions. New contracts are subject to the latest terms posted on this website and sent with every reservation confirmation.
3. Additional policies
This agreement also incorporates the policies and documents published elsewhere on blackdoglimo.com. To make your time with Black Dog Limo an enjoyable one, we ask for your cooperation with the following.
4. Compliance with the law
Black Dog Limo enforces state and federal law and maintains a zero tolerance policy. No alcoholic beverage may be consumed or used by any person under the legal drinking age of 21. No person may bring contraband or illegal substances aboard a vehicle owned or operated by Black Dog Limo.
The chauffeur may search bags inside the vehicle for illegal substances at any time. If the chauffeur finds an illegal substance we may end the contract at that moment, and it is then the responsibility of the client to make their own transport arrangements. The full amount of the reservation will be billed and no refund will be issued.
Black Dog Limo will never leave a minor stranded. The vehicle stays on site until every minor has been collected by a parent, legal guardian or other responsible adult.
We do not travel on unpaved roads. The chauffeur will not drive on dirt, gravel or any other unpaved surface, and has final authority over where the vehicle goes. Roads that are dangerous, or too narrow for the vehicle, will be avoided. This rule cannot be modified. If a pickup or drop off point cannot be reached on a paved road, it is the responsibility of the customer to reach the vehicle named on the contract.
5. Alcohol
Black Dog Limo does not permit alcohol to be consumed inside company vehicles. This applies to sedans, SUVs, passenger vans, executive Sprinters and buses. Please finish any drinks before entering the vehicle.
6. Liability
Black Dog Limo is not responsible for injury caused by horseplay while the vehicle is moving or standing still, and is not responsible for belongings left behind, whether the client is inside or outside the vehicle. The person who purchases the contract is responsible for their guests.
If we determine that any of the policies above have been broken, Black Dog Limo may end the service to the client and is then treated as having fulfilled its obligations under the agreement.
7. Damage to the vehicle
The purchaser agrees to be fully liable for all charges that may be incurred:
- $ 500.00 minimum per damaged seat
- $ 200.00 minimum per damaged carpet
- $ 500.00 minimum per damaged mirror
- $ 200.00 minimum for extensive cleaning, for example spills
- $ 50.00 for gum in the carpet
- $ 250.00 minimum for shampoo and disinfecting, for sickness inside the vehicle
- $ 150.00 for detailing and wax, for sickness on the outside of the vehicle
- $ 500.00 minimum for each burn hole, rip or tear to upholstery
- $ 250.00 minimum for each act of vandalism
- $ 250.00 per incident of smoking inside the vehicle. The ride is ended after a second incident, and smoking is not tolerated
- $ 1,000.00 minimum for opening a vehicle door into another vehicle or a stationary object. Please allow your chauffeur to open your door
- $ 400.00 minimum to replace a damaged flat screen
Inciting others to damage the vehicle will also result in charges. For example, if insults are shouted at pedestrians from the vehicle, any damage the other party causes is your responsibility.
This is not an exclusive list. Any and all damage to the vehicle, including loss of revenue while the vehicle is off the road for repair, can and will be charged to the credit card used to book the service. If the card cannot cover the damage, Black Dog Limo reserves the right to file suit in Palm Beach County, Florida to recover the loss.
8. Our guarantee
Black Dog Limo cannot guarantee that overtime will be available on an hourly rental. Please allow for anticipated delays and keep to the agreed schedule. If you want to change the timing of your itinerary you may do so, provided we can still accommodate clients who booked before or after your journey. Where it applies, you agree to pay additional charges such as overtime, tolls and parking, and you authorise Black Dog Limo to charge them to the credit card on file or to a direct bill account.
Our vehicles are checked constantly to keep them to the highest possible standard, and we will send the vehicle named in the contract. We may upgrade or switch a vehicle in the event of a breakdown or an accident. This happens only in an emergency, and there is no additional charge to you when an upgrade is made without your request. A switch within the same category, or an upgrade, does not affect the contract or its payment. You accept that a replacement vehicle may be substituted if the contracted vehicle becomes unavailable for any reason.
If any of the guarantees or contracted terms above cannot be met for reasons outside our control, including weather, accidents, storms, traffic congestion, road closures and flight delays, we will make reasonable efforts to tell you about the conditions and about any delay or change that follows.
9. Disputed charges and terminated rides
If a customer disputes a charge with their credit card company, a fee of $25 per disputed charge is charged to the customer. If the dispute is found in the customer favour the fee is dismissed. If Black Dog Limo is found to be correct and has provided both parties with proper documentation, the $25 fee per disputed charge is charged to the credit card on file or to the direct bill account.
By accepting services from Black Dog Limo you give up the right to dispute charges through your credit card company for rides that were ended because of the prohibited actions and behaviour described in this contract.
10. Payment, deposits and fees
Driver gratuity is discretionary. You can give it to the driver in the car at the time of the service, or set it on the reservation so it is charged to the credit card provided.
Our rates take account of the fees that come with the service, including tolls, parking, fuel and airport fees. All bookings require a credit card on file. Vehicles booked by the hour require a deposit. Service charges are applied to the card provided at the time of booking, and a payment receipt is emailed automatically the next business day.
11. Early morning and late night journeys
Our standard hours are 5:00 am to midnight, seven days a week, and a journey outside those hours is arranged on request. A pickup between 11:00 pm and 5:59 am carries an additional charge of $10.00.
12. Cancellations
Sedans, SUVs and standard passenger vans
For a one way airport or non airport transfer, a cancellation within 3 hours of the scheduled pickup time is billed at 75% of the quoted service fee. A change to the pickup time within 2 hours of the original scheduled time may be treated as a late cancellation at 75%.
Executive Sprinters and buses
For a one way airport or non airport transfer, a cancellation within 24 hours of the scheduled pickup time is charged the full quoted service fee.
13. Hourly bookings: deposits and cancellations
The deposit is set by the hourly rate of the vehicle, and every deposit is billed at the four hour minimum rate.
A cancellation within 15 days of the contract date is refunded 50% of the deposit. A cancellation within 72 hours of the contract date is charged the full deposit, and no refund applies.
14. No shows
A no show, or a cancellation once the driver is on site, is charged the full service fee. Deposits already paid are applied to the balance due.
15. Refunds
All deposits are non refundable. A cancellation must be made by certified letter to Black Dog Limo at [5192 Pine Abbey Dr S, West Palm Beach, FL 33415] at least 72 hours before your rental.
If there are fewer than 72 hours until your rental you are responsible for the total contract price, which is charged to the credit card on file. If there are more than 72 hours until your rental you may cancel and pay only the deposits already paid under the terms of this contract.
16. Your obligations
The person signing this contract confirms that they have read the terms above, that they are the authorised purchaser for the rental agreement and the authorised cardholder for the credit card given, and that they are the party responsible for payment of the total amount due. Personal cheques are not accepted.
You agree to pay for any and all damage your party causes to Black Dog Limo, and to pay the deposit or the entire contract price under the cancellation terms above. Black Dog Limo reserves the right to charge the full contract amount 24 hours before the date of service. By agreeing to these terms, signing and providing your credit card details, you authorise Black Dog Limo to charge your card for the deposit, for all services rendered, and for any damage to the vehicle. Overtime hours or fees resulting from damage are calculated and billed within 72 hours of the completion of the service.
If for any reason you are not fully satisfied with the service you receive, you have 24 hours after the job is completed to notify Black Dog Limo and file a complaint in writing. If we do not receive a written complaint within that time, the service is taken to have been satisfactory. We will contact the purchaser within 24 hours of a complaint to settle the matter. Every reservation is issued a confirmation number and sent electronically to the email address given by the contract holder.
17. Governing law
This agreement is governed by the laws of the State of Florida. Any dispute arising from it is subject to the exclusive jurisdiction of the courts of Palm Beach County, Florida.
